Damages by a Dog.
At the E.M. Court yesterday the case was heard R. Stallard v. D. M. Hanna. —^Claim for damages done at Awapuni by defendant's dog'- to -sheep of plaintiff, 6 sheep killed andjothers more 'bf leas flayed. Mr Staita for plaintiff and Mr Atkinson for defendant* Plaintiff gave evidence to being with Berqnest and his son on 15th April and neeinaj three dogs? worrying his sheep ; the dop of defendant kilted one she«p before hi« eyes, subsequently found five others. There were between 800 and 900 sheep, they were all chased about. The sheep were breeding 2-tooth ewes and 4tooth valued at 12s each, besides those sheep killed there were a number bitten m the neck and other parts of the body. It was between three and four o'clock m the afternoon. The same evening" called on defendant and was shown the dog. Tiie dog had a red mark on it then. It was m the shop lucked up. C. Berquest gave corroborative evidence. The defendant and his witnesses deposed that the dog was tied up at home between the hours on the date mentioned on which it was alleged that the sheep were worried. The Court save judgment for plaintiff for amount claimed with costs, amounting altogether to £13 10s.
