PREFERRED FLOGGING TO GAOL.

Auckland, November 1.

A request that he be flogged instead of forfeiting any remission of the sentence he is now serving was made by Charles Hayward, who, with Harris O’Neill, was brought before his Honour Mr Justice Smith to-day for sentence for escaping from the Mount Eden Gaol and stealing clothing. His Honour said that he must impose a thoroughly deterrent sentence. O’Neill would be sentenced to three years’ hard labour, and Hayward to two years, the terms to be served after their present sentences. Hayward: I have lost any remission of my present sentence through this act. If it lies in your power, your Honour, I would sooner take a flogging and leave the sentence as it i®. His Honour’: No, I cannot do that.
