Wilson > Esqs., J, P.'b.) , Frederick Fountain was charged that he did feloniously steal take and carry away from a bedroom, in the Manawafcu hotel, F.ixton,, one gold pin of the vrtliie of one pound of the goods and chattels of one George Donaldson; ■•■••■'• George Donaldson gave evidence, ns f o the loss of the pin. "WalterMarley said he knew the Accused. In August the accused brought a pinto him; whilst .hi Iras in bed, and made him a present of it. and then borrowed ss. He wore it, and ultimately gave it to tb.3 constable. G. A. Tapp stated he received a gold piu from W. Marley, When lie read the charge to accused he said ' he knew n 'thing about a pin. Frederick Fountain said he purchased the pin in front of Hunter's for 2s On following day he gave pin to Marley. It was not likely he would Bteal a pin and then give it io the most intimate friend of the prose* . cu tor's to wear. The Bench after adjournment said that there a reasonable amount of doubt aa to -whether he really, stole the pinornotandW.ie case would be dismissed.
