THORPE v. THORPE

Caroline Thorpe (Mr R. McCallum) made application for a divorce from her husband, George B. Thorpe, on the grounds of desertion. The facts, shortly put, were that on the 28th August, 1893, petitioner and respondent were married at Kaiapoi, and they lived together till 1898. In that year her husband went away to look for work and was absent for a time. The petitioner had seen him only once since then, in 1899. He was a quiet man, but weak and easily led. He had done nothing to support her or her two children since 1899. He had deserted her entirely since that time, and she had had no communication with him. An order for maintenance was made against the respondent but was disobeyed, only two payments having- been made. The petitioner and her mother were heard in evidence, and his Honor granted a decree nisi, with costs on the lowest scale, the decree to be made absolute in three months, an interim order giving the mother the custody of the children.
