TIMARU, Nov. 1. In a suit, D. C. Turnbull and Co., grain merchants, Timaru, v. F. Macmanemin, Ellerslie, Auckland, for £47 9s sd, value of a consignment of oats sold to defendant through one Kohn, a grain broker of Auckland, it came out that the defendant had paid Kohn for the oats before he received them. Plaintiff stated that he shipped to defendant, not to Kohn; in fact Kohn had died before the oats were shipped. Council, for the defence said that, after seeing plaintiff's books, he advised settlement. It was unfortunate that the defendant should have to pay twice. Judgment was for plaintiff. THE GENERAL ELECTION. AUCKLAND, Nov. 1. Sir John Findlay addressed the electors of Parnell to-night, following closely upon the lines of the speech previously delivered by him in Auckland. He received a vote of thanks and confide nee. CHARGE OF THEFT. WELLINGTON. Nov. 1. Frank Roberts, custodian of the Wellington Opera Hous~, was charged at the Magistrate's Court to-day before Mr W, G. RidtfeJl. S.M., with theft of a hamper of leather samples valued at £47. The hamper was consigned about a year ngo by Warnock Bros., Auckland, to Dunedin ; but failed to reach there, and the Union Steamship Company had to pay the full claim in April last. The hamper was found in the house of an expressman at Newtown, to whom it had been delivered. It appears that the hamper had been unshipped with a lot of theatrical property at Wellington. Accused pleaded l not guilty, and was committed for trial.

The Ashburton Agricultural and Pastoral Association's 34th annual show was opened to-day in fine weather.
