GORE. This Day. (Before Mr Geo. Cruickshank, S.M.) Deputy Oflieial Assignee (Mr Henderson) v. W. Dickson, judgment summons for £2 2s 6d. —To be paid in two instalments, in default seven days' imprisonment. C. G. Thurston (Mr Henderson) v. Jas. Greig, judgment summons for £3 Is.—To be paid in three instalments, in default seven days's imprisonment. Tuinbull and Son (Mr Neave) v. Kerr and Smith (Mr Bowler), claim £46 12s, value of sheep alleged to belong to plaintiffs, and sold by A. Ford and Henderson and Batger to defendants.—Mr Bowler applied to have Ford and Henderson and Batger joined as defendants with Kerr and Smith. The sheep were sold on Ist December by Ford to Kerr and Smith, but when they went to take delivery on the 10th Henderson and Batger had a bailiff in charge. After Kerr and Smith got delivery, plaintiffs made a claim for a number of the sheep, and if it were proved that they belonged to plaintiffs it might involve a charge against Ford. After discussion, an order was made to join Ford and Henderson and Batger as defendants, Kerr and Smith to pay their costs if the Court thought fit, and costs amounting to £7 10s were allowed to plaintiffs for the adjournment. J. A. McLean (Mr Neave) v. Kerr and Smith (Mr Bowler), claim £1 ss.—A similar order was made in this case, no costs being allowed. K. T. Coomer (Mr Neave) v. M. Livingston and M. McDonald (Mr Stout), claim £SO on a dishonored promissory note made by McDonald and endorsed by Livingston. Evidence had been given at Wyndham by Mrs Livingston, and Mr Neave now gave evidence for plaintiff and called John Penney, manager of the Bank of New Zealand at Mataura, and plaintiff.
