Southland land Hoard.
, * Tuesday, 14th May. Tbe ordinary meeting of the Board at Invercargill was attended by the Chief Commissioner (Mr G. W. Williams), Messrs C. Cowan, A. Kinrose, and J. Mclntyre. An application from J. E. Watson and Gr. Williamson for 50 acres at Oyster Cove, Port Pegasus, Stewart Island, was grantfd, the intention of the applicants being to use the area as a site for a fisb-fretzing plant. Mr Fletcher appeared in support of an application to transfer perpetualleaso sections 692 and 693, Hokonui, from Archibald McDonald to Agnes Theresa Boult. The leases had been originally taken up by W. J. Ward, but" afterwards cold by the mortgagee, Mr McDonald, Mrs Boult being the purchaser for L 520, stated by Mr Fletcher to be its full maiket value. — Mr Moffett appeared on behalf of Mr Ward to oppose the transfer, on the grounds that the Board had not) agreed to the mortgage, and that the sale had been forced and was iireguler. — After hearing both counsel, the Board dec'ined to sanction the transfer, or take any action in tbe matter, intimating to Mr Fletcher that his proper course would be to move the Supreme Court in the matter. James Whybrow applied for seotion 12, Haldane State Farm Settlement. — Referred to Commissioner to deal with. Tbe following applications to oomplete purchase were granted :—Honry Templeton, section 2, block 2, Otara; ! John Kirknees, section 1, block 1 2, Otara, The following applications for the transfer of leases in perpetuity were granted:-— David S'otb to Jobn Whybrow, section 40, block 2, Waikawa ; James Whybrow, sen , to F. Whybrow, section 4_, block 2, Waikawa ; James Whybrow, jun., toF. Whybrow, section 43, block 2, Waikawa. The transfer of the perpetual lease of section 15, block 7, Wendon, from Edmund Argyle to J. J. Argyle was sanctioned. Ranger Campbell repoited that a number of settlers had failed to tflVct the required improvements on their sections, and it was resolved to serve j them with tbe usual notices. Tbe following applications were granted : — Cash : David Macpherson, seotion 8. Niagara township, Lease in perpetuity: George Warren, section 10, ] block 12, Oteramika : John HoffmaD, jun., section 36, block 6, Otara j Anna Hoffman, section 39, block 6, Otara i village homestead allotment; Richard Robertson, section 37, block 7, Waikawa village. The Southland Education Board intimated approval of the school site applied for by tbe Caroline School Committee. — Government to be recomnicndrd to withdraw the site from the ' reserve, and veit it in the Education Board. j Tbe following communication was received from the Department of Land cud Survey, Wellington : — '* Doubts having been expressed aa to the meaning of the 7th covenant in the _'-h schedale to the Government to Settlers Act, 1894, which fixes the time within which the power of sale on default may be exercised at 14 dayp, whereas subjection 8, of section 83 of the Land Act provides for one montb, it has been decided that the provisions of tha Lind Act in this respect aro not altered or governed by the Government Advance to Settlers Act, and that therefore auy consent of a Land Board to a mortgage under the latter Act would not enable the Superintendent as mortgagee, to exercise his right of sale otherwise than ia provided for in the section of the Land Act above quoted." — Received. The Board then adjourned.
