The Justice, after liearing the arguments of both sides of tlio Court, granted the appeal. The presiding Baron, in de l; voring judgment, stated that the case against Mr O’Su’Pvan must he heard again on the ground that the PoPce Magistrate acted wrongly in disir'ssing the charge in the lower court.
