The oats case in connection with t lie J. G. Ward Fanners Aiaociation came before Mr Justice Williams iu Chambers at Dunedin on Monday, in the shape of a summons iu John Council and Co, v. Colonial Hank, for directions as to the taking of accounts and making inquiries directed by the judgment. Ou Hist December, 1 S«».">, the Association drew a cheque on its woiking account at the bank of New Zealand, which had taken over the account on 18th November, and purchased a cable draft or transfer. That was the act of the Association paying its debt to Council and Co. Tho bank argusd that that was equivalent to payment by the Colonial Bank to Connell and Co. of part of the money for which it had to account under the judgment. Further, it was contended that the bauk was entitled to the amount as a just allowance for money which it was made responsible for. Mr Jii-tice Williams made an order that the bank uas not to bo allowed to credit for the t'oOOO.
