Mr Owens, in reply, said the roai was for public nse, except within 70 chains of th 1 pit which he claimed as his tramway. The tota I length of the road for public nse was about one am | a-half miles. Tbe lessee of the new coal-pit couh ' get to it without interfering with his (Mr Owens' : private road. He believed an action concernitif 1 the matter would be brought before the Warden oi ' the 16th instant. 1 The Council believed that Mr Owens wai entitled to something for maintenance as in past | years, bnt the engineer said it would be requisiu first of all to ascertain what had been done. It was ordered that the matter he held over ti' next meeting, as the minute hook which was in tin Supreme Court, Dnnedin, would not be availabh for reference till after the sittings of the Court. The engineer in the meantime to inspect the road 1 and report at next meeting. 1 j Rt letter from Mr Adams, Chief Surveyor, askiiu ' information as to extension of roads for which j moneys were required. Mr M'Dongall said that the extension of road in ; block XIV., Wanaka, was the first iu his district I requiring attention. It was resolved, accordingly, that the sum ol \ £250 be applied for for the work. The Chairman said that an application had been . mentioned by Mr Daniel at previous meeting ! regarding money required for block at Reea Valley j in which Mr Haines' land was. The matter was held over till afternoon when j Messrs Dauiel and Butement were expected to lie j present. The Council then adjourned till the Afternoon Sittings. The Chairmin—We hive gone to great expense in carrying a drain down the surveyed line, and if a road has to lie made it might require special drainage, ami be very expensive. The application was or.iered to stand over till next meeting, the engineer in the meantime to make an examination as to probable cost of the Work, etc.. and bring up rep rt on same. The application of Chinese miners, Gleuorchv, for permission to mine on road was granted, provided the public did not suffer. With regard to Messrs O'Calla-jhan's application for prospecting assistance at Car irona. Mr M'Dongall considered the application was deserving of favourable consideration, if it had l*en lodged iu projier form. The ground convenient had been immensely rich, but there was a blank and applicants were tiying to catch the run of gold again. He piopnted That the request of Gin You and Gin Wie, Cardrona. for assistance under Prospecting Reflation! be recoti. mendi-d, protided Mr BUck is favorable to prosecution of the work. Seconded by Mr M'Bride and carried. An application for slaughtering license was granted to John Cockbum. Arthur's Point. Mr M'Bride called attention to the i>ad stite of rreek between the faims of Messrs Pritchard and Keriu, but the Council took no steps in the matter. (Mr V. H. Daniel here took his seat.) Mr Aspinall brought up his notice of motion table I at previous meeting-, with regard to reduction of jetty dues for sailing vessels oil the lakes, and he pmpnfd That the motion levying jetty dues on sailing vessels, at the rate uf Jtt 10* each, be rescinded. I Mr Butement here took his seat.) Kurt In r discussion took place concerning the subject of circular from the Chief Surveyor, Dnnedin, with respect to estimate of B»m required to ! open up Cro»u lands. It was decided to forward applications as follows:—Haines' crossing, Rees \ alley, £500: Cardrona Crowing, £">00; ami Gleudhu lilurT to Thomson's freehold, £2OO, and extension of Glendha road up Matukituki Valley. 7.V the drdroua Forest Nursery, a return was laid on the table showing that, for the past twelve months, the receipts had been £2B fis lid, and the expenditure £3l 10s 3d in addition to £22 Is paid foi wages. Mr Butement (County treasurer) said that Mr Batkin, assistant controller, htd instructed him to rei-eive mouihlv statements of the nursery finances. The Chairman said Mr Batkin was very dissatisfied with the way thing.) had gone on, and as one instance mentioned that sundry acouuts sent in by Mr Stud holme, amounting to £2O had not been pro|ierly passed. Mr MTMi.all said the deficiency arose through accounts sent out and mouey for bame not being collected. Mr Jenkins remarked that he noticed the accounts alone |aid Min-e ISS'2 amounted to £l4.'i 9s lid. This was altogether too much. He proposed That Mr Black, county engineer, be instructed to collect outstanding Nursery accounts forthwith. Seconded by Mr Aspinall ami carried. Mr Butement, in continuing the subject, said the question was— Could the Council carry on the nnrscry? There had not l>een £2OO received altogether since 1882. He thought it was a nice institution, but if it could not be carried on without lose he should propose to close it. (Mr Butement made a motion to this effect, but afterwards withdrew it.) Mr M'Dongall thought, before taking any final step, that the chairman and himself should draw up a ic|H,rt and <-omplcte finnn.-ial statement of matters connected with the nursery. He therefore proposed— That the Chairman and Mr M'Dougall visit the Forest Nursery prior to next meeting, and report as to the desirability or otherwise of the Council carrying on the institution. Seconded by Mr M'Brile. Mr Daniel called attention to the list of accounts ,

in which there was £l9 against his name as the proceeds of tfees sold by auction at Arrow town. '

f Mr H. B. Smith had sent the money by cheque t< r the late clerk, with account sales for same. Al I the treei were not sold, and be (the speaker) gavi some to Messrs Butement and M'Bride, leaving thi clerk to send in accounts to them, r Mr Butement—l have received no account. t Some members said that Mr Daniel was liable foi c ' payment of the amount to the Council. Mr Daniel denied this, stating that he was onlj • an agent. Mr M'Dougall's motion was then put; when Mi i Jenkins said he did not se* what Hap the use ol i carrying on what waa a white eh pliant, r Mr M'Dougall's motion was put, after furthei 1 discusssion, when councillors voted as fo'lows : i Ayes—Messrs Boyes, Daniel, M 'Bride and I M'Dmigall. Noes—Messrs Aspinall, Butement, I Jenkins and Pritchard. The chairman gave hit I casting vote fur the motion, which was carried. ) It was resolved, on the motion of Messrs Bute- ; merit and Aspinall—i That the expenditure and receipts of the Cardrona Nursery for the last three yean be laid on the table at next meeting, with a view to the future dealing with Nursery. The Ch iirinan read the following memo, received ' by him from Mr Batkin, who, h*> siid, was anxious 1 to get the opinion of the Council on the matter : salary or cissa. An entry in the minute book appear* under date the 23rd 1 November, 1881, and after those minutes hod been signed as confirmed by the signature. (Signed) "Fred. H. Daniel, Chairman. 9,182." The minute is in the handwriting of Boult, and is as follows: " By order of the Council (in Committee of the whole) the amount of salary overdrawn by the Clerk was remitted." (signed) Fred. H. Daniel, Chairman. The minute has no date. Assuming the minute to hare been written on the Oth January, 1882, at which time the Clerk had drawn his salary up to March, 1882, that i< to say, for three months in advance, amounting to £O2 10s, it teem* strange it was not acted on. No such remission was made, for in the 55 months—Januarv, 1882. to 30th April. ISSd-.luring which Mr Boult was in trie service of the Council, he only drew 50 months' payments of salary. C. T. Batkin. January 17,1887. Councillors said they never remitted three months' salary, hut S'-me of tlum recollected remitting one month. Mr Daniel said thit the Council, some yeais hack, remitted one month's Siiliry to Mr BouL in consideration of certain extra sen ii'es. The Chairman said there was no defal -ation. but Mr Batkin was puzzled to know why Boult should lnve done what lie did. Mr Jenkins asked how the Council wis going to pay for current accounts amounting to i'oOO, whilst they ha-1 an overdraft of over £1(100. The Cletk said that the limit of overdraft was £IBSO, but money had come in lath, and, taken altogether, the Council only required about £SO to make ui>. Mr Jenkins did not approve of the way the Couni'il hail to keep its nose to the grindstone, and suggested the adoption of provisions of the Act allowing them to borrow to pay off the overdraft. Mr Aspina 1 did not see how the Council were to carry on if not allowed a larger overdiaft. Still, he j was glad to «ee the overdraft reduced. »» tin y d for a longtime been paying the hank over £! a day for interest. The Chairman said that there wore £lO2 10« 'f rates dna for the present year, and which should be collected. The Clerk —Am I supposed to call upon each r tepsyer individually? I cann >t do that; ratepayers are supposed to come to the Council Chambers to nay. Mr A«pina!l— I propose tint the rates due be pli-ed in the hands of our soli-itor. Mr Jenkins proposed that the Clerk do the work the same as in other conn tie*. After further discussion it was resolved, on the motion of M-sirs Daniel and Aspinall— That the Clerk he instructed to insert a notice in the Arrow and panere, to the effect that, all rate- unpaid on 31>t March he Mied for without further notice. With regard to duty paid to Crunwell hanks on I Cntreil void, the Chairman said (in reply to Mr Aspinall) that the c< unty solicitor, Mr Turton, stated that he had been too busy since last meeting with county embezzlement cases, etc., to attend to the matter. Some nf the councillors suggested tint Mr Smith, solicitor, should ie engaged, but no further action was taken, and the subject dropped. Mr Jenkins desired to call attention to a sfafemeut mile by the chairman at previous mreting th it some councillors' travelling abowan -e had I ecu overdrawn. He was sfterw rd« t-'ld by the chair•inn privately rh it he (Mi Jenkins) was the member. He then had an iuteiVew vvitli Mr Batkin, who gave him a list of alleged piyment*. The first amount was t'9 12s for ei-ht mifiitics in ISS'J, l>ut he found the voucher was ii"t receipted, nor ha I he ever received that money. Mr Bit (tin said lie <•■ ul I not account for it. but it was pii-l ; it was put :n with other vo icher*, making a cheijue fur £29 5* There was al»o another voucher for £S bU for attending meetings in IBH4 5. whidiwa* included in other moiievs. making £77 7* 6d. There «; ( s a receipted voucher supoosed to lie in his name, bet he knew nothing about it. He was represented, according to the County Council hooks, to have attended 55 meetings, hut Mr Mr Batkin statd that he only attended 42 meetings. Corrwtlv siieakinir, Mr Jenkins said he had only received £4S altogether, but was entitled t<> £"io Bs, so that the Council was indi bted to him £'2 Ss. Mr Daniel—l quite recollect the circumstance. It was £1 H<. and I went with y'>u to the late clerk for the amount. Mr Jenkins —I saw- the voucher in the office receipted bv yon fur £2 Ss. Mr Daniel- I never got tVie money.
