MAGISTRATE’S COURT

CHRISTCHURCH. Mr T. A. B. Bailey, S.M., presided at the Magistrate’s Court yesterday. Harvey Roland Birch Miles (Mr Cassidy), charged with committing incest, was. remanded until Thursday. An application for bail was refused. John Wilson, charged with being in arrears on a maintenace order, was sentenced to fourteen days’ imprisonment, the warrant to bo suspended should the arrears bo paid. Alexander Fergus was ordered to pay £ls 2s 6d on a maintenance order, in default one month’s imprisonment. Alfred Edward Laney was sentenced to seven days’ imprisonment for disobedience of a maintenance order, the warrant to bo suspended provided he paid 2s 6d weekly in addition to the amount of the order. Robert Wilson, for being £4 17s 6d in arrears on a maintenance order, was sentenced to fourteen days’ imprisonment, the .warrant to bo suspended on condition that he paid off the arrears. At a sitting of the Juvenile Court yesterday, before Mr T. A. B. Bailey, S.M., a. boy charged with stealing a leather sovereign case and calendar, tlie property of the D.1.C., was admonished and: discharged. Four small boys wero charged with stfealing sweets fr,om a penny-in-the-slot machine at tho Grand Theatre. Two were ordered to report to the probationary officer and not to go to picture shows f.or three months, and the others were admonished and discharged. Two boys,charged with breaking a street lamp, were ordered to pay 7s 6d each. A boy wag charged with having an air-gun dn his possession, and the gun was confiscated. LYTTELTON. Captain R. Hatehwell, J.P., and Mr W.. C. Cleary, J.P., presided at the Magistrate’s Court at Lyttelton yesterday." • William John Fox and Mary Scott, charged with being the owners of unregistered dogs, were convicted and fined 20s and costs each, and ordered to register the dogs within seven days. . ASHBURTON. Mr V. G. Day, S.M.. presided at the Ashburton 'Magistrate’s Court yesterday. Michael Harry . Godby (Mr Acland), William A. Gunn, Frederick Ludeman, George Duncan Macfarlano and J. D. Stewart were each fined 20s and costs for driving motor-cars at an excessive speed within the borough limits. David Marquet and Janies Mollison, for speeding with their motor-cars over the AsKburton traffic bridge,, were each fined 20s and costs.' Benjamin Butcher, for a similar offence in respect to a moior-cvclo, was fined 20§ and costs. J. J.‘Dolan, charged with diverting water from . a water-race under the control of . the Ashburton County Council without obtaining pel-mission of the council, was fined £lO and costs. Charges against William Keating and Charles Robbins of failing to send their children regularly to school wero adjourned for three months, to enable the children to attend more regularly. ■ Murdoch Bruce (Mr Acland) proceeded against Robert Frisby (Mr Buchanan), for .£2OO, being the valno of some owes alleged to linve been in lamb, but which proved not to bo in that condition. Mr Buchanan said the case centred round the value ,of the sheep, and suggested that an arbitrator should bo appointed. Mr Acland being willing to fail in with the suggestion tlie magistrate said he would try and appoint a competent person, and adjourned the case until January 8. Robert Henry Davis, proceeded against Andrew Brady Simpson and Eva Margaret Simpson for a dissolution of partnership with respect to a horse, and claimed £25 as his share. Mr Buchanan appeared for plaintiff and Mr Acland for defendants. The Magistrate held that there was a partnership. He suggested that tlie horseshould bo valued, and that one of the parties should buy the other out. The case was adjourned until January 8, in order that a settlement might bo arrived nt.

Walter Glendenning was charged that on October IS he did sell to E. N. Johnson, health inspector, milk with a percentage of milk-fat less than 3J parts. Defendant stated ho bought tlio milk from a man named Hunt. Mr Johnson said ho had taken two samples of Hunt’s milk and found it all right. A fine of £5 and costs £2 9s was imposed. Judgment was given for plaintiffs by default with costs in the following civil cases:—G. H. Hcfford and Co. v. J. H. Condon, £3 16s; Ernest Healey v. Thomas Hocking. £2 10s; D. Miller and Co. v. H. Hanson, £3 3s Id.
