RAILWAY APPEAL BOARD.

The Railway Appeal Board for the South Island continued its sittings yesterday, the mombers consisting of Mr W. R. Hoselden, S.M. (chairman), and Messrs John Grav and J. H. Jones. G. GILLESPIE'S APPEAL.

G. Gillespie appealed against his transfer from guard to shunter on the ground,that he had failed to report an unusual occurrence) on his train, which had run late between Kaiapoi and Bennett's on September 24, 1910. Mr Cameron appeared for appellant, and Mr Davidson for the Department. For the Department it was stated that appellant had made a report as follows:—" Engine F 24 broken down." When asked for a fuller report he had said that something had gone wrong with tho engine, and water had had to be taken from an adjoining creek to set it going again. The appellant's first report had not been in accordance with the regulations. Mr Cameron contended that the appellant had carried out his duty in reporting a breakdown on the engine. It was for the driver to report what had happened. ' , _ , r ~ G. Gillespie, F. A. Nealo, S. M. Bennetts and J. M'Neily gave evidence on appellant's behalf. Decision was reserved.

H. B. SCHOW'S APPEAL. H. E. Schow, apprenticed boilermaker at tho Addinqton Workshops, appealed against his not being retained as a journevman boilermakeron the completion of his apprenticeship. Mr Hampton appeared for the appellant, and Mr Davidson for the Department. . • • , , For the Department it was stated b.y James Thomas Henderson, workshops foreman', that appellant had been indentured for five years. His progress had not been satisfactory, and did not warrant the Department retaining his services at the expiration of his apprenticeship Witness admitted that the appellant had served a probationary, period prior to bis being indentured, and that his conduct during that time had not warranted any complaint.

Decision was reserved. G. 11. FEARN'S APPEAL. G. H. Feani. clerk, appealed against tho withholding b.y his superior officer of the certificate required to give him the annual increment provided by the Classification Act.

Mr J. G. Macpherson appeared for appellant, and Mr Davidson tor the Department. Cyril Henry Bias, district traffic engineer, said that appellant was a member of his staff. Ho had not recommended appellant for an increase in salary, as lis considered him inefficient. Appellant had not made as much progross in capability as he should have done, and his capability was not commensurate with the salary he was receiving.

James Young also gave evidence for the Department. Decision was reserved.
