AN INTERRUPTED WEDDING

A FALSE DECLARATION. . MrH. W. Bishop, S.M., heard a case at ~ the*? f Magistrate’s Court yesterday in. winch Herbert Donald Jarvis (Mr Kirk) pleaded not guilty to a charge of knowingly and wilfully making a falsa declaration, for the purpose of procuring a Registrar’s; certificate, under the Marriage Act, 1904. - L. G. Williams, Registrar of Births, Deaths and Marriages, gave evidence that there was an entry of marriage, number 637, on October 9, 1905, in tho name of Herbert Donald Jarvis, who f described himself as a-bachelor; twenty- 1 four years of age, occupation sign*. )writer, and a resident of Christchurch for three yeax-s. He had stated that there was no impediment of kindred or alliance, or other lawful hindrance, to. prevent his being united in marriage with the person named in the declaration. On May 30, 1904, there was au entry, number 344, wherein Herbert . Donald Jarvis, describing himself as a ; bachelor, occupation mariner, aged," twenty-six, applied for a marriage certificate with another woman. Ho had then made a similar declaration to the one in 1905. A certificate had ben issued to him. _ > The mother of accused's wife gave evidence that accused was about to go through the marriage ceremony at; St ; Mary’s Church, Addington, with the second girl, when she (witness) objected to the proceedings, on the-grounds that ;; his wife was alive. Accused said he was divorced, which was untrue.'. i Edward Walker, bootmaker, said he was present, as “best man, - ’ when accused was married in June, 1904, and signed the register, produced. Mr Kirk objected to accused’s wife , being called to give evidence against him, and the objection was upheld. Accused' reserved his defence, and was committed for trial at the next - session of, tho Supreme Court. Mr Kirk applied for bail. ■ _ . • The Magistrate said that bail could not be made light. The accused could-• have bail in one surety of £l5O and.two of £25 each. 1 ;
