The following Bill has been brought in to remedy the existing state of the law as to the appointment of constables. Owing to the fact that by the Empowering Ordinances in different provinces, the Superintendents clothed themselves with all the power of the Governor in this matter. But the Governor's power was to appoint constables for the colony, which no Superintendent can of course do. There has been this fault from the first. A BILL, INTITULED AN ACT TO CONFER ON SUPERINTENDENTS OP PROVINCES CERTAIN POWERS WITH REGARD TO THE APPOINTMENT "OP CONSTABLES WITHIN SUCH PROVINCES. Whereas by an Ordinance of the Lieu-tenant-Governor and Legislative Council of New Zealand, intituled " An Ordinance to provide for the establishment and maintenance of a Constabulary Force," it is provided that it shall be lawful for the Governor to cause fit and able men to be embodied as a police force, to act as constables in and throughout the colony, and also to appoint officers for such force, and to make regulations for the management, discipline, and employment of such force. Be it enacted by the General Assembly of New Zealand, in Parliament assembled, and by the authority thereof as follows : — 1. The short title of this Act shall be " The Provincial Constabulary Act,1865." 2. All such powers as by virtue of the said Ordinance are conferred on the Governor, may, within the several provinces of New Zealand, be exercised by the respective Superintendents of such provinces. Provided that nothing herein-contained shall prevent the Governor from appointing constables under the authority of the said Ordinance. 3. Nothing in this Act contained shall prevent any Superintendent and Provincial Council of any province from making laws concerning the establishment or maintenance of a constabulary force within such province.
