Magistrates Court, Arrowtown. (Before F. J. Burgess, Esq., S.RL) Tuesday, September. 24. Stock Inspector v. T. Allan. .For failing to dip sheep tinder sub-section 6, Stock Amendment, 1895. A second charge also made against defendant for sending in an inaccurate return. MrW. Turton for the Stock Department. Defendant pleaded guilty to both charges, but asked to make a statement regarding the latter charge. Mr Turton said he might mention in justice to Mr Allan, that tho latter fixed a date for dipping the shefip, but the weather was on the particular date such as to make it detrimental to do so. However, Mr Allan would, he understood, be making a statement himself. Defendant said he had arranged to dip the sheep on the 27th May, and in sending in his return on the 25th of that month, he did so being sure the sheep would be dipped on the 27th. Unfortunately bad weather came on, and as the ewes were in lamb, he did not do so. The Magistrate said he could not deal with the latter charge the same as the case in Queenstown recently, as Mr Allan was in full knowledge that the sheep were not dipped when the return was sent in. He, however, was satisfied that Mr Allan wrote to the Stock Inspector being fully convinced that the sheep would be dipped on the date mentioned. This had certainly to be taken into account. The maximum penalty was £IOO, and the minimum £lO. He had to hold that defendant was guilty of the offence, and would inflict the minimum penalty of £lO. In respect to the first chargefailure to dip sheep—he would in this case fine on the maximum penalty, which was 8d per sheep—374 sheep—£ll3s 6d. Costs in both cases, £'d Is —in all £l7 14s 6d.
