DAMAGES CLAIMED
TE KUITI TAXI ACCIDENT. WOMAN’S SKULL FRACTURED. A claim for £516 damages for alleged negligence was brought by Margaret Douglas, a married woman, of Te Kuiti, against William Clokey, taxi and service car proprietor, of Te Kuiti, before Mr. Justice Herdman and a jury in the Hamilton Supreme Court yesterday. In her statement of claim plaintiff alleged that defendant so negligently backed his car in Rora Street, Te Kuiti, on May 29, that he knocked down and ran over plaintiff, who sustained a fractured skull, two fractured ribs, loss of memory, bruises and other injuries. It was alleged that defendant backed suddenly without warning at an excessive speed. Special damages totalling £6l were claimed and £SOO general damages. The defence claimed that the accident was due to the negligence and inattention of plaintiff. The jury returned a majority verdict for plaintiff for £461 16s.
