JUDGMENT SUMMONS.

INSTITUTING PROCEEDINGS. SERIOUSNESS OF ACT. The seriousness of the act of insti tuting judgment summons proceedings was impressed, upon a judgment credito< in the. Magistrate’s Court at Blenheim by Mr T. E. Maunsell, S.M., (reports the "Express).. Counsel for the judgment creditor had drawn the Court’s attention to ‘ the fact that judgment was obtained against his client on 4th March, and the judgment summons was issued on 30th March. Addressing the judgment creditor, a dressmaker, his Worship stated that she appeared to have allowed the defendant too little time to find the necessary money after judgment had been obtained. “Did you realise what you were'doing when you instittued these further proceedings?” he asked. “Do you know that when you took out this judgment summons you were calling upon this man to show cause why he should not be committed to prison because he had supposedly had money to satisfy the judgment over and above the amount required for the reasonable maintenance of himself and his family?” The judgment creditor’s reply was inaudible. When he was informed that the debt was incurred in the purchase of a dress for the defendant’s wife, his Worship asked the judgment creditor why she had not got her money before parting with the dress? “She asked me to let her have it to oblige her, as she wanted to go to a dance,” the reply. ' ... “I am sorry, but I think you have fallen in,” commented the Magistrate. After further examining; the debtor as to his means, Mr Maunsell said he could make no order, but he advised the creditor to take proceedings again in six months, when he would jxrious ly consider making an order. /
