CLAIM FOR COMPENSATION. ACCIDENT NOT REPORTED. A decision in favour of the defendant company has been given by the Arbitration Court iiri a reserved judgment dealing with a compensation fclhim brought by Henry James Lindbom, a yardman, of Waitalm, against A. R. Wallis, Ltd., a company carrying on business as sawinillers at Greymouth arid elsewhere.

The statement (if claim alleged that on March 31 last the plaintiff, when working with a mate in tlie defendant's yard at Waitalm, slipped and fell while in the act of throwing a board upon a stack of timber from a lorry on, to a railway truck. As a result he strained his back and by reason of the / accident become totally disabled . from working as from August 1 last. The judgment stated that during the four months from March 31 to August 1, throughout which the plaintiff alleged he was disabled from carrying J out his normal work, he took no steps to see that thq ,defendant company was advised of the accident. If the acci-j dent occurred as alleged, the failure to, give notive had prejudiced the defend-, ant company in preventing it from checking and verifying the happening of the accident and from having the < injury propqi;ly treated at an early stage. The failure in the Court’s opinion could not lie said to be due to mistake or other reasonable cause. For such reason the Court was of opinion that judgment must lie entered for the defendant company,
