The judgment of the Full Court in what is known as the “Companies’ Commission case,” heard on April 18 and 20, was delivered by the Chief Justice (Sir Michael Myers), this morning. ' : Judgment was given for the defendant commissioners, the Court holding the appointment 6f the Commission to be intra vires, in .that it had been appointed to inquire both into the operation .of'.'existing legislation relative to company matters, and also into legislation. The writ 'of' prohibition asked for could not be granted, W the Court was satisfied that the;Commission could exercise no judicial ’ functions, and was not a judicial tribunal in any legal sefiseh. That' tieing so, the questions of bias or pecuniary, interest did not arisoy and the charges 'made in that respect bv plaintiffs were not considered' by the Court.' Costs amounting ito thirty-five guineas were allowed to the defendants.
