HOKITIKA BOROUGH COUNCIL.

FRIDAY, JULY 13th, 1928,

The Council met at 7.50 p.m. Present:—Messrs G. A. Perry (Mayor), T. W. Duff, A. C. Armstrong, J. King, E. W. Ileenan, and Dr Teichelmann. Apologies were made for the absence of Messrs Elcock, Evans and Jeffries.

The minutes were confirmed and correspondence outward approved.

INWARD CORRESPONDENCE

From Town Clerk, Palmerston North, re hospital management.—Received. From Greymouth Harbour Board, asking the capital rating value on population of the Borpugli of Hokitika at date.—Received; information supplied.

From Renton and Co., agents, Royal Insurance Coy. Ltd., asking for share of Council’s insurance business.—Received.

From New Zealand Refrigerating Coy. Ltd., Christchurch, intimating that 26 sheep were delivered into Hokitika during the month of May, and forwarding cheque for £1 6s.—Received.

From Deputy-Chief Inspector of Explosives, re proportion of dangerous goods license fees payable to public account.—Received.

From G. B. Haussmann, Brittan Street, asking for water service connection. (Work approved by Town Clerk and installation made.) —Received. '

From District Telegraph Engineer, Christchurch, asking for information respecting the cost per unit for lighting and power.—Received. From Inspector of Public Health, Greymouth, advising cases of diphtheria, and requesting that notices be served to certain householders. —Received.

From S. A. Clarke, Sewell Street, in reply to notice sent to him under the Public Health Act.—Received; to be requested to comply with the notice sent him.

From the Board’s representative, No. 12 District Highways Council, intimating (1) That widening proposals in Fitzlierbert and Stafford Streets are satisfactory, and that Main Highways Board will subsidise the work on a construction basis of £1 per pound; ('2\ that total estimated ordinary maintenance on highways amounting to £219 will be subsidised at the rate of 30s to pound; (3) authority covering 1 and 2; (4) intimating that in regard to tarsealing highways and boroughs, the Board lias decided that except in special cases which will be dealt with on their' merits, the subsidy will be limited to a width of thirty feet.—Received.

From W. H. Gifford, Hall Street, application for bath and storm water connection with street drain.—Received; request granted on usual conditions. From George Huxford, Fitzlierbert Street, asking for a few loads of gravel on the footpath, Fitfilierbert Street, from Warren’s- corner to opposite Mandl’s Brewery—Received; referred to Public Works Committee.

From Mrs E. T. Nightingale, and Messrs E. and W. Ross, protesting against the leasing of portion of right-of-way.—Received ; to be notified the Council was not leasing the section. From L. Gooch, accepting the terms for leasing Reserve No. 520 and Pt. 801, expressed in Council’s letter of tho 4th instant.—Received ; deferred awaiting dedication of gravel pit.—Received. From Westland Hospital Board, accepting tlie terms for leasing Reserve No. 473. Sewell Street, expressed in the Council’s letter dated the 4tli instant. —Received.

From Mrs B. T. Thompson and Miss F. A. Thompson, re Reserve No. 534. Received ; transfer agreed to, subject to payment of rates due. From P. J. D. Kinvan, application for leasing Part Reserve No. 492, and asking conditions. —Received ; deferrred for valuation.

From Mrs E. E. Orr, application to lease Part Reserve No. 492, and asking for particulars of terms and conditions. —Received; deferred for valuation. From F. Oliver, application to lease Part Reserve No. 492, and enquiring terms and conditions. —Received ; deferred for valuation.

From John Cameron, asking tor reconsideration of terms for leasing Reserve No. 471.—Received ; the Council resolved that the year to year lease he allowed at present rate, but if a permanent occupancy he desired the Council’s offer must he accepted. REPORTS. From Treasurer reporting receipts £224 3s 9d, payment £460 2s Bd, credit balance £963 8s lid. —Received. Accounts amounting to £lB6 17s 5d were passed for payment. FOREMAN’S REPORT.

1 beg to report the following work was carried out during the month : The sidling at the corner of Bealey and Stafford Streets was ve-timbeied. A drain was put iu at the Post Office yard and Bealey Street drain was excavated to the wooden drain between Weld Street and Gibson Quay a distance of 6 chains 60 feet, requiring 102 pipes. This work took up the test part of the month. A new pipe was put in the water main on North Revel! Street, and on two occasions the line burst between the Kanieri Forks and the lake one on the 15th and the other on the 29tli, which were repaired. In respect to the pipe line we require to have a stock of pipes on hand , in case when repairing is carried out, that the pipes are not fit to repair and have to be replaced with new ones.

We have a small number on hand, chiefly 14ft 6iu pipes and 10ft Sin. We require G, 7,8, and 12 foot lengths mostly. The water in the reservoir averaged Sft 4in for the month.

—Received and adopted. The pipes to he purchased up to a cost of £IOO. From Manager Abattoirs (J. Jarman) reporting during June there were slaughtered—22 cows, 24 heifers, 64 bullocks, 194 sheep, 17 lambs, 24 pigs, 15 cows. Condemned—3 cows. Fees for tbe period £67 (£6S 5s 6d last year).—Received. RESERVES COMMITTEE’S REPORT I beg to report that the Reserves Committee met on Friday, the 6th instant. Present—Cr. Evans (Chairman), Crs. Duff and Teichelmann. Absent—Cr. Ileenan, being unable to attend.

The application from Mr J. J. Breeze jnr., referred to your Committee for report has been investigated by the Town Clerk, and bis report is as follows :

“ (1) The Crown survey made in 1863 shows tbe right-of-way as now shown on Borough map ; that is hounded on north-east by sections 333 and 132. “ (2) By conveyance 1501 (ID 107) dated 19th July, 1870, Section 682 was conveyed to the Corporation, as a public right-of-way; leases for 999 years (peppercorn rental) were granted over parts of 682 to certain persons, being owners of adjoining sections 177, 131, 156, and 126. “ (3) By D 4,1320 of 11th January, 1866, a right-of-way through sections 120 to 282 was vested in the Corpora-

tion, linking the right-of-way from Hamilton Street to Weld Street.

“ (4) Under Section 171 (d) M.C. Act, 1920, the right-of-way is a street and the Council have no power to lease any portion of it.” Wo recommend that applicant be informed that the Council have no authority to lease the portion of the right-of-way.

The matter of leasing Whitcomb© Square was considered. This is an endowment, and to provide satisfactory leases, it-will be necessary (1) to have a fresh Land Transfer Plan of the area prepared at a cost of £8 Bs. (2) To have the sections having a frontage to an existing street valued by a competent valuer, and negotiate with present tenants for leases on basis of new valuation. (3) To dedicate a road through the Reserve as shown on recent survey plan. (4) In negotiating with tenants the lots shown on survey plan should be adhered to, so that when leases are completed the existing fences should be aligned with the survey pegs. The Town Clerk is submitting to tlie Borough Solicitor legal points respecting the Council’s leasing powers, and if the reply is satisfactory, we recommend that the leasing of this Reseive be proceeded with without delay. Received and adopted.

The Mayor moved that Mr M. Houston be appointed valuer of the sections and that the Town Clerk be authorised to procure a new survey of the square and that consideration of applications to lease the reserve be deferred until the valuations are made. Seconded by Mr Duff and carried.

The Mayor moved that the necessary action he taken to alter a gravel reserve in Stafford Street to an endowment reserve, the gravel pit being exhausted. Seconded by Mr A. Armstrong and carried. A request by Dr Teichelmann that necessary blinds he procured for the Town Hall was referred to the Town Clerk to report. The Council rose‘at 9 p.m.
