'The Court of Appeal is hearing an appeal hv the Palmerston North Borough Council against the decision of Mr Justice Reed on the ‘Hit of June, James John Casey being the respondent. The facts were that the respondent submitted under Section 33n oi the Municipal Corporations Act. 11)20. a plan of a sub-division ol land prepared by a licensed surveyor showing the allotments and the proposed street. Permission was granted in ai-i-ordanee with existing conditions relating to the

construction of private streets. Ihe street was then formed and metalled as specified, hut when the instrument of dedication was forwarded to the council for execution that hotly demanded LJl.'i he deposited for tarring and sanding the road. The respondent objected to the sum, eventually paying it under protest and then bringing an net ion against the Council tor the recovery of the amount so paid. Tho Judge decided that respondent was entitled to a refund and this finding is now appealed against.
