APPEAL COURT DECISION. WELLINGTON, May 4

The Appeal Court gave judgment today in th# Dominion Picture Theatres v. Whiting. The Court held that wages were not payable under the award unless the performer was performing, and consequently there had been no breach of award. The question of costs was held over. The question dealt with was whether a penalty had been incurred for a breach of award, and the judgment expressly forebore to, deal with the question . whether under the contract between performers and employees, tlie former had any claim.
