MAGISTR ATE'S COURT HOKITIKA

Charles Wasley (Mr Murdoch) v. Frank Graham (Mr Pillcington), claim £3O 126, in connection with training the racehorse Gallupin in November and December last, and charges paid. James Johnstone, hotelkeeper, Hokitika, gave evidence that the defendant requested witness to engage Wasley as trainer of the horse, and gave witness written authority to take charge of the horse. He had instructed Wasley accordingly, and TV asley had taken charge and trained the horse. William A. Wilson, accountant to M. Houston, gave evidence of receipt
of all order from Graham to pay over the winnings of Gallupin at Kokatahi. '|'liis was given effect to. Charles Wasley (plaintiff) gave evidence that Johnstone engaged him on behalf of Graham to train Gallupin. He had brought the horse from Han llari, had trained it and had paid the fees included in the claim. Graham took the horse away on December 29th without consulting witness. Graham paid the riding fee when Gallupin started at- the Hokitika races. When training three days before the meeting Graham said the horse was not looking too well. Witness replied that it was looking 100 per cent better since tnkin,r charge of it. Tt was then agreed to"start the horse once to see how it ran Spoke to Graham about payment and he said to hold it over till he fixed Up with his farm. . , The hearing was then adjourned to next sitting, the defendant counsel havin'* the right to cross-examine, and the defendant to then ho in attendance.
