At the Supreme Court, Victor Rupert Anderson was charged with escaping from legal custody while under-remand for theft* He disappeared from Waikato Hospital, where he was undergoing treatment. Counsel moved to quash the indictment, claiming that accused was not in lawful custody at the time of the escape. His Honor said it was the first timet the question had arisen in New Zealand. The jury returned a verdict of guilty on the facts, but the point whether he was in legal custody and bad committed a criminal offence was reserved for the Court of Appeal.
