James Granville proceeded against Joseph Sraitheraiii for the recovery of certain goods alleged to be in the "possession of the defendant at his farm, Hurleyville, or their value (£95), and also £25 damages for their detention. The defendant counter-claimed ;'for £70 for the use by plaintiff of certain property at Hurleyville. Mr D. G. Smart appeared for the plaintiff, and Mr P. ODea for the defendant. The plaintiff gave evidence in support of his claim, -but under crossexamination admitted that most of the items he was claiming for, with the i exception of some furniture, had not ! been paid for. The defendant, in his evidence, ' stated that he had never received any demand, beyond the summons, . from the plaintiff for the goods claimed; all that the plaintiff asked for after witness' re-took possession of the farm was his own personal belongings, which were given to him.
