Received 9, 10.19 p.m. SYDNEY, ,Dec. 9. An important ' decision as regards skipping was given by Justice OWen. Tbe Briscoe Company sued the master of the steamer Gulf of Bothnia to re' cover compensation for a quantity of cargo _ consigned from Bristol. The Bothnia called at Albany to coal, and shortly afterwards several feet of ' water was found in the hold, and plaintiff's goods were submerged. , Their contention was that there was not only a warranty by the owner that the vessel was seaworthy when she left Bristol, but in a fit contrition to carry cargo after she left Albany. Justice Owen granted a nonsuit, holding that no fresh warranty attached at intermediate ports where' the vessel railed to replenish her -coal to complete the voyage ; but granted a stay, of proceedings, as the point was important and had not before been decided.
