A BETTING CASE.
JUSTICES AND MAGISTRATE. STRONG REMARKS BY COUNSEL. (per press association.) Dunedin, February 21. At the Police Court, a second charge against Peter Grant of betting on the New Zealand Cup race was proceeded with. The Crown Prosecutor said he would rely on the authority of Mr Justice Williams' decision in a former case.
After evidence had been heard, Mr Sim, for the defence, said that what the Bench had to be satisfied about was whether beyond all reasonable doubt the bargain between Greeney.and the accused was a wager on " tote " odds. In the books Greeney was apparently credited with £1 10s. The dividend paid by the totalisator was £9 11s, and the difference showed it was not a wager at " tote " odds.
After some consultation between the Bench (composed of Mr Carew, S.M., and Messrs S. G. Smith and A. G. Christopher, justices), in which the Magistrate appeared to take little part, Mr Carew said the opinion of the Bench differed, and the case would be dismissed.
Mr Fra9er, Crown Prosecutor: Just so. The Justices have over- ruled the Magistrate. Ido not; intend to proceed further. We are on the verge of a public scandal.
Mr Carew said Mr Fraser should not make these remarks.
Mr Smith, J.P., thought the remarks uncalled for. In eaoh case the thing bad not been proved. Other charges were adjourned till 6th March.
