Giving Beer to Railway Servants

(Otago Daily Times.) At the Inveroargill Police Court, last week, before G. E. Kaweon, 8.M., Thos. *t Harley, delivery carter to Mr J. T. Martin, of the Blaok Eagle Brewery, Inveroargill, appeared to answer a charge that be did give a gratuity— to wit, two gallons of beer — to Daniel Hinton, a railway servant in the service of the New Zealand Bailway Commissioners, contrary to the rail* way by-laws. Mr T. M. Maodonald appeared to prosecute on behalf of the commissioners. Mr Battray, for the defendant, raised a preliminary objection to the proceedings, ' on the ground that the by-law .under which the information was laid was ultra vires. Mr Macdonald contended that the 37tjfr eection of tbe Government Bailways Act, 1887, validated all the by-laws, whether legally made or not; and Mr Bawson held this view to be the right one. Mr Battray then said there was nothing for him to do but to aßk that a nominal penalty be inflicted. Tbe offence oonld not be denied, but the act of tbe defendant has been customary amongst brewers fortbe last 20 years. Now tbat it was known to be illegal a stop of course would be put to tbe practice complained of. Mr Mcdonald said tbe department bad no desire to press for a heavy penalty. It might or might not be tbe case tbat the praotioe complained of bad prevailed amongst brewers for a considerable time— from an inquiry instituted by Mr Wbitoombe it would appear tbat tbat statement was correot, but tbe practice bad been carried on surreptitiously. The acts were that tbe beer bad from time to time been placed in a cupboard in one of the goods sheds, for tbe use of tbe railway servants, and tbat becoming known bad led to tbe inquiry mentioned, and to the dismissal of some of tbe railway hands. It was subsequently determined by the Commissioners to instruot Mr Wbitoombe to take tbeae proceedings in order to give the brewers' aotion publicity, and make it known tbat by supplying liquor to railway mon on duty bad oaused three men to be dismissed and others severely punished ; but no doubt a moderate penalty would serve tho ends of justice. Mr Battray said defendant did not know he had acted surreptitiously. Tbe present traffic manager bad not been here very long, and knew nothing of the praotice. Mr Macdonald .aid the thing was only discovered a short time ago, and neither the past nor present managers had known of it until then. Defendant was fined Is. with costs amounting in all to £1 11s. Francis Downie, carter to Mr L. G. Boope, of the Southland Brewery, Inveroargill, on a Bimilar charge oh a different date, was fiued Ib, with costs £1 Bs.
