NEW PLYMOUTH, September 17. The Union Company's s.s. Takapuna was berthed at the wharf this morning in order to discharge thirty tons of heavy machinery for the Waitara Freezing Works. Tbis is a satisfactory proof that the dredge is doing good service in clearing away sand at the breakwater.

Sharrock v. Mehaffy. — Mr. Gaplen for plain tiff; Mr. Fookes for defendant. The dispute was to the following effect : — A tender from Sharrock was accepted by Mehaffy for cuttings and rough levelling on a racecourse at Stratford at a certain price ; it was alleged that Mehaffy, through bis engineer, ordered certain deviation necessitating extra work ; when completed the contractor brought the total amount up to £335 ; tbe plaintiff alleged that Mehaffv declined to pay this sum, and asked plaintiff if he could reduoe the amount. The plaintiff told defendant the job was worth £400. £190 had be paid, and plaintiff sought to reoover the remaining £145. Plaintiff declared he had paid £315 in wages. Counsel for defendant alleged that the work had not been done in manner agreed upon. Defendant did not authorise deviation of the course ; it was done by plaintiff on his own responsibility. The oat-e was partly heard on Thursday. There was a good deal of contradictory evidence. Several witnesses were called, and plaintiff and defendant were cross-examined at length. Eventually, His Honor decided to adjourn tbe oase until the 28th inst., Mr. Climie meantime to prepare a report on the work done.
