SCOPES INDICTMENT QUASHED.

BUT HE IS STILL ON HIS DEFENCE. (Received This Day, 10.10 a.m.) ' NEW YORK, July 15. The Court upheld a motion to quash the indictment of Professor Scopes at Dayton. Tennessee, but, ruled that defendant be required to plead further. (Received This Day, 11.55 a.m.) NEW YORK, July 15. The trial at Dayton l is practically over' so far as the County Court is concerned. The, presiding Judge declared in a lengthy statement that the Tennessee law prohibiting the teaching of evolution is constitutional. The defence admits that Professor Scopes violated this law and therefore it remains only for the jury to be instructed to return a verdict of guilty. A fight upon the constitutionality of the law will be made in an appeal to the higher court. It is probable, however, that before the trial actually ends there will be many speeches delivered and possibly expert testimony will be taken.
