An application for discharge from bankruptcy in respect of the estate of Thomas A. B. Hudson, Levin, wn.s made by Mr H. Hooper at the Supreme Court before the Chief Justice, Sir Robert Stout. ."Mr .Simpson, official assignee© and official 1 i(/tiidator in the estate of Hudson and Marriott, Mr Gardener. a creditor in the bankrupt estate, and Mr 0. Tn respect to poods sold for Collio. a Wellington debtor, a portion of the money from the sale wa.s paid to him and the remainder to the firm's account. Collie had received two cheques, one of which had been dishonoured. The. amount due to Collie totalled CoO ss. This transaction t-ook place, while Marriott was a partner of the firm. Gardener's account was for moneys collected by bankrupt during the timo the tatter was solo partnor in the firm. The account was in respect- of the sale of some land, the money for which had been collected in instalments for Hardener, but with all of which the latter had not been credited. Bankrupt had sold land for a Mrs Owen, and had collected the amount, which he paid over to her. Mrs Owen lent the firm £50, which, with £50. balance on purchase money due. made 5100 due to her.

Mr Simpson stated that- the total debts of the firm amounted to £2071 lis Id. Further questioned bankrupt- stated that .lie had mortgaged his furniture to assist the firm. His wife at times received small sums of money, which wore paid to him. Mr Gardener: Did you carry out the financial arrangements of tlie firm? Bankrupt: Both my.-elf and Mr Marriott had the same responsibility. Mr Gardener: How much did you pay Marriott wh<?n you went out? Bankrupt: About of which Bome CoO was paid in cash and the balance in promissory notes. Mr Gardener: How many of these notes did you pay? Bankrupt : T may hare paid one of £10.. Mr Gardener: Then Marriott wont out with only a little over £50. Bankrupt : Yes. Mr Gardener cross-examined witness at length in regard to tho tak ing over of n butchery business in connection with which. It was stated. a loss had been sustained of about CBOO prior to bankrupt taking it over. His Honour stated at the conclusion of the evidence, t.hat he would adjourn the case, either to Wellington or Palm erst on North, at « date to he fi^ed.
