Restitution Not a Mere Formality By Telegraph—Press Association AUCKLAND, Ajjril 7. “In all eases of application for restitution of conjugal rights, the Court must be satisfied that there is a genuine desire for the respondent to return to the petitioner,” said Mr Justice Fair to-day during the hearing of a petition for restitution. When a wife left her husband with out any marked differences of opinion or quarrel and the husband made no serious attempts to persuade her to re turn, that naturally casts some doubt on the genuineness of his request, said His Honour. He didn’t consider it proper to treat these cases as a mere formality. His Honour made an order for the wife to return to her husband within 28 days in the case in which Lewis James Kinross sought an order for res titution against Doris Kinross.
