PRIVILEGE OF M.P.
• * Motoring Breach Case CHARGE DURING PARLIAMENT (By Telegraph—Press Association.) CHRISTCHURCH, Sept. 17. Unusual circumstances were disclosed in a traffic prosecution this morning, when Mr. Jeremiah Connolly, M.P., was charged under Waimairi County Council information with overtaking a vehicle on an intersection on July 7 when driving a motor car. The question of privilege arose, as section 267 of the Legislature Act, 1908, stipulates that a service on an M.P. during a session of Parliament shall be invalid, provided the member has not been guilty of felony or misdemeanour.
The problem was overcome through counsel for defendant pleading guilty. The Magistrate, Mr. E. D. Mosley, convicted and discharged defendant, stating that he had submitted 1 to a penalty which it was doubtful if the Court had power to impose.
