Holding there to be insufficient evidence on which to commit the defendant for trial, the Magistrate, Mr Paterson, dismissed a charge of theft against Frederick George Voyle, aged 36, formerly agent for the New Zealand Co-operative Pig Marketing Association, in the Hamilton Police Court to-day. Evidence was called to show that the accused was given £498 19/. which he paid into an imprest account, upon which he wa 6 to operate tor purchasing calves on belt. If of the association. Ou Voyle’s engagement being terminated he was asked for th 0 return of scales, books, etc. The imprest account cheque book was not returned, and £5B 13;was unaccounted for. The Magistrate said that in order to establish a case the prosecution must show that the accused, in violation ol good faith, committed an offence and fraudulently applied some of the money for some other purpose. The Court had no explanation of what had become of the money. The case was too incompiete to send the accused for trial.
