NAPIER MAGISTRATE’S COURT

(Before Mr. A. M. Mowlem, S.M.) CASES HEARD TO-DAY. For carrying on a second-hand shop without the necessary license, John Leckie (Mr. S. H. Morrison) was convicted and fined £2, with costs 10/-. A fire of £5, with costs 10/-, was imposed upon Nellie May Truman (Mr. R. J. Gifford), the licensee of the Empire Hotel, who was convicted on a charge of selling liquor after hours on February 14 last. In imposing the fine, His Worship drew attention to the fact that the defendant had been before the Court on a previous occasion for a breach of the licensing laws. ‘‘She was fined £3 then, but it apparently wasn’t enough,” he said.

Henry Bull was convicted and fined £2 with costs 10/-, for being found on the Empire Hotel after closing hours.

The same defendant was also convicted and ordered to pay costs, 10/-, for aiding and assisting the licensee of the hotel to supply liquor after hours. A fine of £2, with costs 10/-, was imposed upon Charles St. John Cunningham, who was convicted on a charge of being found in the Empire Hotel after hours. For aiding and assisting the licensee to supply liquor after hours, he was convicted and ordered to pay 10/- costs. For failing to keep to the left when riding his motor-cycle along the Wairoa-Bay View road, John Moa (Bay View) was convicted and fined £l, with costs 10/-. Edward John Basher was before the Court on a charge of being 12/0 in arrears with the payment of maintenance in respect of his child. He was convicted and sentenced to seven days’ imprisonment and ordered to pay costs of 10/6. For being £7 in arrears with maintenance for the upkeep of his child, Charles J. Theyers was convicted and sentenced to seven days’ imprisonment and ordered to pay costs amounting to 10/6. A sequel to an accident on the Takapau Plains on February 20, when a motor truck crashed into a bridge, causing considerable damage to the side rails, and resulting in the truck falling into the river and becoming a total wreck, was the appearance in Court of Wilfred John Hicks, who was charged with negligently driving a motor lorry. He pleaded not guilty. Constable J. Williamson gave evidence that a few days after the accident he took a statement from the defendant wherein he said that he bad had a heavy day’s work and had dozed at the wheel. His Worship entered a conviction and fined defendant £l, with costs 10s.
