POWER POLES

QUESTION OF REMOVAL. WHOSE RESPONSIBILITY? On whom rests the liability for the removal of power poles to a new aligmnment when counties undertake road construction work ? This is a question that is to be settled for all time by a case which is shortly to be brought before the Supreme Court by the Southland Electric Power Board. Intimation to this effect was re ceived at Tuesday’s meeting of tho Waiteniatu Electric Power Board, which is vitally interested in the subject in view of the fact that certain poles on the Titirangi highway being constructed by the Waiteinata County Council have to be shifted. The board, having been asked to bear portion of the cost of tlte work, recently obtained a legal opinion as to its responsibilities in the matter. This is cuculated among other boards in the Dominion. A reply was to' hand from the Hawke’s Bay Electric Power Board stating it understood a test case was being brought in the Supreme Court by the Southland Power Board to settle the question of the liability foi the removal of poles for all lime. It was further pointed out that the Hawke’s Bay County Council from time to time .requested the board to alter certain poles, and it was thought that, if the cost of the alterations was the county's responsibility, the requests for removals would be less frequent. The letter was received.
