At the Napier Court yesterday afternoon, before Mr. A. M. Mowlem, S.M., John Hepburn Stewart pleaded not guilty to charges of negligent, driving and with driving at a dangerous speed on the Napier-Wairoa road. After hearing the evidence, His Worship held that the principal witness for the prosecution, Arnold E. Stewart, who was driving the lorry with which defendant enine into collision, was also guilty of negligence, and decided that he should also be charged with negligent driving, Upon the police charging him he was fined £2 and £1 7/6 costs. His Worship deferred penalty on the original defendant until this morning, when lie stated that he was satisfied that although the defendant was affec*ed by the negligence of the other driver, there were outstanding features which showed that the defendant was also negligent. A fine of £l, and £1 7/6 costs, was imposed.
