GREEN LANE ASSAULT CASE

MAGISTRATE’S DECISION. £l5 COMPENSATION AWARDED. The two young men charged with a midnight assault at Green Lane (Auckland) on the night of December 26 last, A H. Driscoll (21), jockey, and E. W. Ley don (22), were before Mr. W. 11. McKean, S.M., for sentence on Friday. They were represented by Mr. Singer. The cases were adjourned for six months, without a conviction being recorded, and the Magistrate said he would then dismiss the informations if satisfied with the conduct of the two men at the end of that time. “It is with a great deal of hesitation I have decided to do this.” said Mr. McKean, “although, out of good nature, the two persons assaulted have not pressed for compensation. The assault was entirely unprovoked, it was of a serious nature, at a late hour and the consequences might have been extremely grave,” remarked the Magistrate. He was not satisfied with the explanation of the defendants,. Mr. Singer submitted that a conviction in the case of Driscoll would involve severe hardship. It would deprive him of his livelihood and present him from going on a racecourse again. Driscoll deserved a severe sentence, Mr. McKean said. He added it was his intention to award a substantial sum as compensation, as one of the’ assaulted men received a mark he would probably bear for many years. Accused were ordered to pay £l5 in compensation.
