Prince Humphrey, who created a surprise by winning the Royal Stakes at Ellerslie, carried 7.13, or 21b more than his right weight. It is stated (says the “Star”) that while this was the poundage he was weighed out at. the extra weight was not declared as overweight.- The question was later raised as to whether Prince Humphrey was entitled to the stake. According to the Huies of Racing overweight has to be declared, and there was some difference of opinion as to whether- the simple act of weighing out at 21b over was equal to a declaration. However, it seems that the Rules of Racing cover the matter in this instance, for a horse is allowed to carry 21b over in a flat race without declaration.
