NEWSPAPER TO PAY ALLEGED LIBEL. Sydney. Aug. 17. Alter a protracted legal battle, Mr. T. 8. Role, a well-known property owner and financier, won an action which he commenced several vears ago against “Smith's Weekly” newspaper, in which he claimed £25,000 damages for alleged libel. At the original hearing the jury found in favour of the newspaper. Mr. Rofe then appealed to the State Full Court, which dismissed the appeal. Later Rofe carried the case to the Privv Council, which upheld the appeal, with all costs below to be paid by “Smith’s Weekly.” Subsequently further reference to the Privy Council was made to determine whnt was meant bv all costs below. Tlie Privy Council held that this meant nil costs of the trial at the first instance, also the costs of appeal to the State Full Court and to the Privy Council.
After negotiations “Smith’s Weekly’’ has now agreed to make a public apology to Mr. Rofe. “Smith’s Weekly" will also have to pay the costs, which amount to £BOOO.
