MOTOR TYRES.
A DEFENDED CLAIM. The H.B. Autos proceeded against C. 11. Jonson, fruiterer, of Hastings street, in the Napier Magistrate’s Court this morning for £22 as the amount owing for two tyres sold in July, 1922. Defendant counter-claimed for £22 and costs on the ground that the tyres were quiet useless and valueless to him. Mr Lusk appeared for plaintiffs, and Mr Humphries for defendant. Thomas Clarkson, manager of the company, said that when Jonson returned the tyres they were sent to Wellington and rc-beadcd. The tyres were again offered to Jonson, but he said he was short of cash. However he agreed ' to give a p.n. for three months. Charles West, Napier manager for tho Hawke’s Bay Autos, said that Jonson informed him that he would have to leave the matter of paying for the tyres ; after they had been re-bearded as he was short of cash. Six week? later, Jonson said that he could not meet tho p.n. made for three months, and .another one for three months was prepared Jonson had never refused to take delivery of the goods.
