(Before Mr. R. W. Dyer, .S.M.) Drunkenness —One offender was convicted and discharged. Alleged Assault.—Domini Concotta was charged that on July sth, at Port Ahuriri, he did assault Ballone Gavino by attempting to strike him with an iron. On the application of Mr. Dolan tfor defendant) he was remanded for one week, bail being allowed at £25 in accused’s own recognisance and one surety of £5O. ALLEGED THEFT Alan Beasley (Mr. Rogers) pleaded not guilty to a charge ot stealing, on June 13tli. a bicycle, valued at £5, the property of Thomas Anderson. Senior-Sergeant Eales said on the date in question the owner left the bicycle in a passageway near his house, but it disappeared and he subsequently saw accused riding it in town, it having lM»en newly painted. When questioned about he said his brother had given it to him and had also painted it. Evidence to this effect was given l>y T. Anderson, Constable Murray aud A. J. Howard (Avoca House), who saw him painting the bicycle. The defendant, in evidence, said ho was an inmate of a Receiving Home, but was licensed out to a Mr. Burns, Taradale. When he was working at Taradale he met a chum named Jack Smith and he gave him the bicycle which was rusty and chipped. He told accused ho was going to Wellington, but he did not know v.here he was now. He had known this man for a fortnight and always called him brother.
