Friday, August 16. Mc.Siveeney v. Hallasey.

This was a summons in which the plaintiff sought to recover £ll on an 1.0. U. given by the defendent to him for the unpaid balance due to the plaintiff on a contract for building a house. The contract was <£llo. The plaintiff finished the house in September last, and received at different times .£99. Some four months since, when asked for the balance, the defendant gave his 1.0. U. therefore. For the defence it was contended that the house was badly finished, and that the £ll were not due ; but, after hearing the parties, the Resident Magistrate gave judgment for the plaintiff for the amount claimed, the defendant having his remedy against the plaintiff for breach of contract.

Mr. Allen appeared for the plaintiff, and Mr. B. Taylor for the defendant.
