He stated that the attention of the department having been drawn to the fact that a considerable number, of documents Had been filed and yetithe amount of fees was hot large, an investigation was made, and^ it then, appeared that there was a deficiency of £06'. The defendant was spoken jtp, about it, and was afforded an opportunity of making the money good. He, accordingly purchased stamps to the amount; of ■ £50 and filed the documents duly stamped. Further, investigation, however, led to the discovery that there wfcs still a deficiency to a considerable ex* tent, and again an opportunity ww given to ' the defendant to ' refund ' the money, which he had not availed himself of. He (Mr, Crowlishaw) was then directed to consider , whether criminal proceedings might be taken against the defendant for larceny or embezzlement. He did not, however, see how criminal proceedings could be taken, as the receipt ;of moneys by defendant was not part of his duties as a public servant. He was therefore driven to lay an information, against the defendant under the t Stamp Fees Act, so as to recoup the revenue to the extent of the deficiency. There was reason to believe that in all the cases the defendant had reoeived the fees, but in consequence of the absence of 'some of the parties the evidence in some of them was not at the moment forthcoming. - After some evidence had been taken the case was adjourned.
