Tiie board met. at 2.i5 p.m. I Present— Messrs Kinross, Williams, Common, .Lyndon, Smith, -Robjohns, Vautier, : 'and Lieut. -Colonel Lambert. • Mr Williams 1 was jvoted .to the chair.

The Secretary stated that the meeting* was convened on the requisition of Messrs' Kinross, Lyriddriy .Common, and Lieut. - : Colonel Lambert, and. was a special meeting in accordance with the bye-'av, relating, to .the election of chairman; Mr Buchanan had informed him. that, he (Mrj Buchanan). hacL forwarded his resignation! of his ( . seat jat ;the board, to the Govern-' merit, and had received j aoreply which he| had forwarded, to the .board, together, with! a memorandum from himself. ; '

The letter ..to Mr Buchanan ,was then read. It was. to the . effect -that the Government had no power in the matter, asi section 38 Of the Harbors ' Act- 1878, only. -provides- that resignations should be addressed to the chairman of the board.

The following" -memorandum . by .JVlri Buchanan' was 1 endorsed 6'n' the' f breeding ; letter :— " Section 38 ! ap peats' to 'provide! for resignation by a member only, not for the -resignation 'of -the chairman. For the! chairman to -report his resignation, in i writing' to himself is a self-evident absiir-! dity. -The method best to adopt seems to' be this— lst. The Secretary stated that he had spoken : to the board's solicitor on* the.. -subject, . whose opinion, was that .the board should hold a, meeting; to, elect a chairman and ; then Mr Buchanan's resignation as a member of the board could be dealt with, j but that Mr Buchanan could not resign his seat until a chairman was elected. ° •

The Chairman said the first matter to be dealt with was the resignation of the chairmanship by Mr Buchanan.

Colonel Lambert moved that the resig- | nation be accepted. - - - ■ -

The motion was seconded by Mr Smith and carried.

Colonel Lambert then moved that John Davies Ormond be. elected chairman to the board.

. Mr, Kinross seconded the motion. ; Mr. Smith moved that his Worship the Mayor be elected chairman.

Mr Lyndon seconded the motion

The board divided on the amendment. Ayes, 4 — Messrs Smith, Robjohns, Lyndon, and 'Van tier. Noes, 4— Messrs Kinross, Common -Lambert, and Williams. The chairman gave his casting vote with the noes. , ■

That concluded the . business of the 1 special 'meeting'. An, ordinary meeting, was to h:"ve been held, but. Messrs Smith, Van tier, Lyndon, and Robjohns having withdrawn.at the conclusion of tho special meeting, there was no quorum.
