BYE-LAWS OF THE COUNTY COUNCIL OF HAWKE'S BAY. BYE-LAW No. 1. Regulation" of Proceedings of Council, officers, &c. 1. The sitting of the Council shall be on the seconel Memday of every month, at 11 a.m., unless otherwise altereel by the Council. 2. The first business shall be the reading anel confirming the minutes of any previous meeting, and no eliscussion shall be permitted thereon except as to their accuracy as a record of the proceedings, and the said minutes shall then be signed by the Chairman. 3. After the signing of the minutes as aforesaid the business shall be as follows, unless altered by resolution to that effect : — 1. Reading of copies of letters sent by authority of the Council. 2. Reading letters received, and consielering anel ordering thereon. 3. Reception and reading of petitions and memorials. 4. Presentation of reports of Committees and of the officers of the Council. 5. Payments. 0. Ordinary business. 7. Orders of the day, including subjects continucel from proceedings of former meeting. S. Extraorelinary business and new byelaws, regulations, &c. 9. Other motions, of which previous notice has been given. 4. The Secretary shall send notice of such meeting, addressed to the members, unless otherwise ordered by the Council at least three days previous to the meeting, which notice she XI contain an abstract of the business to be Drought before the meeting. 5. Whenever the Council shall stanel adjourned for wan 1 ; of a quorum, the hour at which such adjournment is maele, and the names of the members present shall be inserted in the Minute Book of the Council, anel the Minute Book be signeel by the Clerk. ORDER, &C, OF DEBATE. 6. The Chairman shall put the question first in the affirmative, then in the negative, anel after the question has been put, and his decision given thereon, a division may be calleel for, anel the Chairman shall eleclare the result thereof. 7. An entry of the division list shall be maele by the clerk in the Minute Book. 8. Any member desirous of making a motion or amendment, or taking part in discussion thereon, shall rise anel address the Chairman, and shall not be interrupted unless called to order, when he shall sit down until the member calling to order shall have been heard thereon anil the question of order elisposed of, when the member in possession of the chair may proceed with the subject. 9. Any member desirous of proposing an original motion or amendment must state the nature of the same before he aelelrcsses the Council thereon. 10. No motion or amendment shall be eliscusseel or put to the vote of the Council unless it be seconded. 1 1 . No motion or amendment shall be withdrawn without leave of the Council. 12. A member proposing a motion shall be held to have spoken thereon ; but a member merely seconding a motion shall not be held to have spoken upon it. 1 3. If two or more members rise to speak at the same time the Chairman shall eleciele which is entitled to priority. 14. No member shall speak a seconel time on the same question unless entitled to reply, or in explanation, when he has been misrepresented or misunderstood. 15. The Chairman shall deciele on all points of oreler or practice without discussing or commenting on the same, anel his decision in each case shall be iinal. IG. No member shall digress from the subject matter of the question under discussion, or comment upon the words used by any other member in a previous elebate. 17. A member calleel to oreler shall sit down unless permitteel to explain. IS. Any member may, as a right, demand production of any documents of the Council that apply to the question under eliscussion. 19. All motions, whether original motions or amendments, sliiill be in •wx'itiug, siyneel by the mover, anel clclivereel to the Chairman immediately on their being moveel and seconeleel. 20. No seconel or subsequent amendment, whether upon an original proposition or on an amendment, shall be taken into consideration until the previous amendment has been disposed of. 21. If an amendment be carried, the rjuestion or amendment as amended shall become itself the question or amendment, whereupon any further amendment upon any portion of the question or amendment, coining after such first mentioned amendment, may be moved. 22. It an amendment be negatived, then a secoiul may be moved to the question to which the first amendment was moved ; but only one amendment shall be submitted to the Council for eliseussioii at a time. 23. The mover of every original proposition, but not of any amentlment, shall have a right to reply, immeeliately aftoi which the question shall bo put from the Chair ; but no member shall be allowed tn speak more than once on the same question, unless permission be given to explain, or the attention of t!u: chair be called to a point oi order. 24. Any one or more of the Bye-laws herein contained may be suspeneleel for thai sitting on motion, eluly scconeled, made without notice, provided that six members, inchuling the Chairman, be present anel con sent thereto ; but notice shall always b< given when practicable. PETITIONS. 27. No petition shall be presented excep by a member of the Council, nor shall an; petition be presented after the meeting shal have proceedeel to the orders of the day. 28. It shall be incumbent em every mem ber presenting a petition to acquaint himsel with the contents thereof, and to ascertah that it eloes not contain language elisrespect ful to the Council. 29. Every member presenting a jjetitioi shall write his name at the beginnini thereof. 30. Every petition shall be in writing, an< shall contain the prayer of the petititioner at the e>nel thereof. 31. Every petition shall be signed by th persons whose names are appointed thorete; by their names or marks. 32. No letters or affidavits, or other elocu ments, shall bo attacheel to any petition. 3:5. Every member presenting a petitio shall confine himself to a statement of th persons from whom it comes, of the numbe of signatures attacheel to it, and of the matt rial allegations containeel in it, and to th i reading of the prayer thereof. All salaries, for officers under th i, control of the Council shall be voted ar L nually, and all engagements entered hit between the Councfl anel its officers shall b i terminable upon one month's notice bein given on either side. In all cases of miscoi duct or incapacity on the part of the officers the Chairman shall have power to suspen any officer until the next meeting of tli J Council, when the matter shall be then elul reporteel. 35. In all cases where any of the officers < the Council arc entrusted with the care c control of the funds of the Council, sccurit shall be given to the satisfaction of the Com oil for the faithful performance of any elut; and the expense of preparing such securii shall be borne by the person providing tl . same.
