A .statement of evidence, taken before Mr Bathgate, the Resident Magistrate at Dunedin, on the loth JMaj', was road by the Clerk of the Court, in which Wilson stated as follows : — That he elid not owe the cash portion of the amount claimed, but that the money hail been given to him by plaintiff as a present. Plaintiff had asked him to go to the "North Island with him as a companion, and he had consented to do so, but told him he

had no money. Gilmour then said he would pay all expanses, as he wanted some one to accompany him. When defendant was in Napier he entered into a contract with plaintiff to build a house for Mr Scale, a runholder. Defendant had not sufficient tools, and plaintiff said he would purchase some, which he (plaintiff) was still in possession of. They were to share the profit and loss equally. Gilmour only worked for a fortnight, saying he could find something better to do. Defendant had to get a man to assist him when plaintiff left. Plaintiff denied the truth of this statement altogether. Wilson had offered to work the money out and to pay when he was able to do so. William Madden deposed that Wilson j told him that he could borrow some money ! from a friend ; they met Gilmour shortly afterwards, and witness understood Gilmour was the man Wilson said he could borrow* money from. Judgment was given for plaintiff for amount claimed, with costs £3 Is.
