RESIDENT MAGISTRATE'S COURT.
Fbiday, Apeil 8. .(Before J- A. Smith, Esq., J.P., H. S. Tiffen, Esq., • • J.P., and J. Wilkinson, Esq., J.P.) LABCENY. John Mac was charged with stealing the sum of 16s, tho property of John Cannon, from a bedroom in the Commercial hotel at the Spit. It appeared from the evidence that on the night of the 7th instant, the prosecutor and his wife (a native woman) engaged a bed at the hotel, and on retiring to rest deposited the sum of 16s in a bag under the foot of the bed. In the morning Mrs. Cannon was awakened by hearing some one in the room, and saw the back of a. person (not her husband) leaving it. The prisoner had slept in the house that night, and had stated to the landlady that he had no mon ey , The bag was found empty on the following morning amongst some clothes belonging to the prisoner under thp pillow of the bed he had slept in. It was also proved that he had changed some money in treating persous at the bar on the morning of the Bth. Mr. Trask, for the defence, deposed that he had given the prisoner money on the day in question, and the Bench dismissed the case. CIVIL CASES. Cosgrove v. Hare Torotoro. — Debt £16 19s 6d. Judgment by default with costs 19s. Monday, Apbil 11. (Before Captain Carter, Esq , J.P., and H. B. Scaly, Esq., J.P.) DRUNKENNESS. George Harrison was charged with this offence, and as he had been previously convicted was fined 10s or 48 hours. BREACH OP MEBCHANT SHIPPING ACT. Donald M'Gilliwray was charged with having refused to leave the steamer Wellington after having been requested to do so. It appeared that the defendant, who was a passenger in the steamer from Auckland, refused to leave the vessel on her arrival at Port Ahuriri, alleging ns a reason that the company wore bound to put him on shore. This the agent declined to do, and requested him to leave the vessel, and on his refusal to do so, although ample time was given him, he was given into custody, The Bench fined the defendant Is and 5s 6d costs.
