RESIDENT MAGISTRATE'S COURT.
(Before John Curling, Esq,, R.M., and H. S. Tiffen* Esq.) Tuesday, December 10. Koch v. Cashmore. — This case was adjourned from Friday last, the 6th instant. Robert Kirkpatrick was called, who stated that he had seen a horse outside the Court, (the disputed animal). It was not the one that he had sold to Mr. Turley, who had sold it to Mr. Koch. The one that he had sold was a white horse with a grey mane and tail, and branded D K on the near shoulder, whereas the horse outside that Mr. Koch claimed was a grey one, and branded like K on near shoulder. Robert Marshall stated that the horse outside was not the one that formerly belonged to Kirkpatrick, as that horse was a white one, with, grey tail and mane, a very good trotter, and branded DX ; the D was indistinct. The defendant produced evidence to prove that this horse had been in the possession of Cashmore for the last ten months, and could not trot at all. The Bench gave judgment for defendant, with costs, £2 135., and witnesses' expenses, £3 10s. Robert Chapman was fined os. for drunkenness. Cuff' v. Murray.— Claim £13 45., for money advanced and professional services. Judgment by default for full amount, with costs. Neal and Close v. Murray.— Claim, £5 ss. 3d., for goods supplied. Judgment by default, with costs. Thursday, December 12. James Woolley was fined ss, for drunkenness. Friday, December 13. Yates v. Haswell.— Claim £2, for a saddle and bridle.
