TIKOKINO RESERVE ACT

An Act to authorize tJw issue of Crown Grants of certain Land situate at Tikokiiio in the Province of Haivlte" s Bay. [14th December, 1863.] Whereas the Provincial Council of Hawke's Bay in or about the month of March 1860 passed certain proposed Supplementary Land Regulations. And whereas the 11th Clause of the said Regulations was in the words or to the effect following that is to say: — "That to encourage the location of the working classes in particular Districts that may be considered well fitted for agriculture the Government of this Province — to wit the said Province of Hawke's Bay — should be authorized to purchase from 1500 acres to 2000 acres of good Land in suitable localities which should be divided into Sections from 40 to 100 acres each and offered to the heads of families on condition of actual occupation subject to the payment of interest at the rate of £10 per centum on the value of the Land which they should have a right of purchasing at any time during a period of Ten years at a rate of Ten shillings per acre" And whereas the said Provincial Council of Hawke's Bay on or about the 23rd day of March 1861 adopted a Resolution in the words following "That to carry out the recommendation contained in the 11th Paragraph of the proposed Supplementary Land Regulations the Superintendent should with the advice and consent of. the Executive Council be empowered to make Purchases out of Provincial Funds of the Blocks of Land alluded to as suitable for the profitable occupation of the working classes" . And whereas acting Upon and in pursuance of the said Resolutions Thomas Henry FitzGerald Esq. then Superintendent of the said Province of Hawke's Bay was on the 2nd day of July 1860 at Public Sale of Crown Lands held at Napier in the said Province declared the highest bidder for

the same the purchaser of all that Block of Land situated in the said Province containing 1740 acres and described in the Schedule hereunto annexed And whereas the said Thomas Henry FitzGerald Superintendent as aforesaid paid the sum of £1541 as the purchase money for the said piece of Land out of the Funds of Revenues of the said Province And whereas no Crown Grant hath yet heen executed in respect of the said Blocks of Lan d And whereas in pursuance of the Eesolutions before recited the Baid Superintendent hath received application from Settlers willing to become the purchasers of different parcels of the said Blocks of Land upon the terms and conditions set forth in the said Resolutions and in some cases such applicants have taken possession of and have expended money on their allotments and in other cases the General or Provincial Government have agreed to grant to such parties specific allotments of Land Be it therefore enacted by the General Assembly of New Zealand in Parliament Assembled and by the authority of the same as follows I. The Short Title of this Act shall be the "Tikokino Eeserve Act 1863." 11. In all cases in which such purchasers as i aforesaid shall have taken possession of and shall have expended money on their allotments And in all cases in which the General or Provincial Government shall before the passing of this Act have agreed to grant to such purchasers specific allotments of land the Governor may issue to such persons respectively Crown Grants of their respective allotments subject to the provisions of this Act. 111. Every snch Grant shall be held subject to thp payment of the sum of ten shillings per acre at the expiration of ten years from the date thereof with interest after the rate of ten pounds per cent, per annum payable half-yearly and such sum and interest shall be deemed to be a tax on such land and may be recovered by any Commissioner of Crown Lands or other person appointed by the Governor in that behalf as a Rate Assessment or Liability recoverable under the "Sale for Nonpayment of Rates Act 1862." IV. Provided that application in writing be made by the parties claiming the benefit of this .Act to the Commissioner of Crown Lands of the Province of Hawke'sßay within six months after the passing of this Act. V. The residue of the said land shall be disposed of by public auction at the upset price of twenty shillings per acre VI. All monies receivable under this Act for Purchase Money Tax Interest or otherwise shall be deemed to be Revenue arising from the sale of Waste Lands of the Crown within the Province of Hawke's Bay.
